The provisions of this chapter are not applicable to: 1. Land use decisions within the city will be guided by information provided on the location of identified mineral resources of regional significance. No excavated materials are sold for commercial purposes. Where a person with vested rights has continued surface mining operations in the same area subsequent to January 1,he shall obtain city approval of a reclamation plan covering the mined lands disturbed by such subsequent surface mining. In no case shall the financial assurance be released until reclamation has been completed. Restoration includes measures to conserve and develop soil, water, woodland, fish and wildlife, recreation sources and agricultural productivity.

In addition to providing the reclamation plan, operators must also post a performance bond to ensure that monies will be available to complete the reclamation if the operator goes out of business prior to finishing the reclamation or is otherwise unable to complete the reclamation. This subsection shall not apply to normal maintenance and repairs unrelated to the reclamation work on public facilities where dedicated to and accepted by the city of Rancho Cordova; The County shall identify such proprietary information as a separate part of each application. After the war, states continued to enact and expand regulatory programs, some of which required mining permits or the posting of bonds to ensure that the land could be reclaimed after mining was complete. The earth moving activities are within oil or gas field properties under a common owner or operator; and 4. The Act authorizes the Secretary to review areas within federal lands to assess whether they are unsuitable for mining of minerals or materials other than coal.

Reclamation activities shall be initiated at the earliest possible time on those portions of the mined lands that will not be subject to further disturbance. Interim reclamation may also be required for mined lands that have been disturbed and that may be disturbed again in future operations or in connection with approved or proposed development. Application for an amendment are subject to the fee in accordance with Section 3. The criteria for release of financial assurances, or part of the financial assurances, shall be made part of the Reclamation Plan. Yet comprehensive information about hydraulic fill is difficult to find. Applications for a site approval or reclamation plan for surface mining or land reclamation projects shall be made on forms provided by the planning department.

None of the minerals being processed is being extracted on site; and 4. The planning commission may conceptually approve the reclamation plan and financial assurance before submittal to the State Department of Conservation. Many lignite deposits lie close to the surface, easily reached with modern mining technology.

Any other surface mining operations that the State Mining and Geology Board determines to be of an infrequent nature and which involve only minor surface disturbances. What do open-pit and opencast mean? As Jimmy Carter campaigned in Appalachia inhe promised to sign those bills.

Reclamation Plans. Applications shall include all required environmental review forms and information prescribed by the planning director. The bond is not released until the mining site has been fully reclaimed and the government has after five years in the East and ten years in the West found that the reclamation was successful.

The County shall conduct an inspection of each surface mining operation within six months of receipt by the County of the surface mining operations annual report submitted pursuant to Section of the Public Resources Code.

Residual hazards to the public health and safety are eliminated. Abandoned Mine Reclamations. Said inspections may be made by a state-registered geologist, state-registered civil engineer, state-licensed landscape architect, or state-registered forester who is experienced in land reclamation and who has not been employed by the mining operation in any capacity during the previous 12 months, or other qualified specialists as selected by the planning director.

No surface mining for uranium is currently conducted but uranium exploration continues to be conducted for in situ uranium mining operations and is administered by the Surface Mining and Reclamation Division in situ uranium mining is regulated by the Texas Commission on Environmental Quality.

The planning department may permit the applicant to amend such application. Any person aggrieved by an act or determination of the planning department in the exercise of the authority granted herein shall have the right to appeal to the planning commission or the city council, whichever is the next higher authority.

Drinking Water and Domestic Wastewater Treatment Plant Operators Establishes requirements for certification of drinking water and domestic wastewater treatment plant operators. Permits for underground coal mining must contain a variety of requirements, including that the operator use the best available technology to minimize disturbance and adverse impacts on fish, wildlife and related environmental values, to the extent practical, and enhance these resources when practical.

The earth moving activities are within oil or gas field properties under a common owner or operator; and 4. Establishes the design, treatment and operation requirements of general permits for laundromats, pesticide waste degradation systems, car wash systems, sand and limestone mines, and tomato wash water.

The city shall establish such fees as it deems necessary to cover the reasonable costs incurred in implementing this chapter and the state regulations, including, but not limited to, processing of applications, annual reports, inspections, monitoring, enforcement and compliance.

Stream bed channels and stream banks affected by surface mining shall be rehabilitated to a condition which would minimize erosion and sedimentation, except that such rehabilitation need not attempt to restore or mimic natural conditions where the contemplated or proposed ultimate use of the reclaimed property would be inconsistent with the maintenance of restored or rehabilitated stream bed channels and stream banks.

Borrow pitting, streambed skimming, segregation and stockpiling of mined materials and recovery of same. Examples of such uses may include, but shall not be limited to, high density residential, low density residential with high unit value, public facilities, geographically limited but impact-intensive industrial and commercial.

Most coal-mining states now have the primary responsibility to regulate surface coal mining on lands within their jurisdiction, with the Office of Surface Mining Reclamation and Enforcement OSMRE performing an oversight role. The Act specifically does not supersede state laws or regulation that impose land use and environmental controls on surface coal mining and reclamation that are stricter than the Act or its regulations.

Adverse environmental effects are prevented or minimized and that mined lands are reclaimed to a usable condition which is readily adaptable for alternative land uses. Prospecting for, or the extraction of, minerals for commercial purpose and the removal of overburden in total amounts of less than one thousand cubic yards in any one location of one acre or less.
